New Damages Liability Act 1st July 2002
The Damages Liability Act was amended in 2001, and
the new Act took effect on 1st July 2002. The new Act
only applies to injuries occurring on and after 1st July
2002. The Act leads to a general increase in the level of
compensation.
Briefly, the new Act introduces wider access to
resumption of compensation cases, so that there is now
a chance of resuming each compensation item
separately. The determination of maximum medical
improvement no longer applies, and under the new Act
compensation for lost earnings must be paid until a
temporary or final assessment of the loss of earning
capacity can be made.
